Clingmarks Holiday Giveaway Official Contest Rules

Prizes

1. Three prizes will be awarded.
2. The first prize is a 4th generation (newest model) Apple iPod Touch 8GB.
3. The second prize is a 6th generation (newest model) Apple iPod Nano 8GB.
4. The third prize is a 4th generation (newest model) Apple  iPod shuffle 2GB.
5. Each person / household only qualifies for no more than one (1) prize.
6. All winners are responsible for taxes and additional fees associated with receipt or use of a prize.
7. Color may vary for all prizes.

How to enter the contest

Choose one of the following two ways to be qualified for the giveaway:

1. Like us on Facebook (http://www.facebook.com/clingmarks) or already formerly become our facebook fan.
2. Mention “@clingmarks” or “@penguinlinks”  in your twitter posts.

Please note:

1. Both “like” and “twit” must be no later than 12/25/2010 11:59:59 PST.
2. You can do both “like” and “twit” to double your chance to win.
3. No purchase required to be qualified for the giveaway.

Entry period

1. All “like” and/or “twit” must be submitted no later than 12/25/2010 11:59:59 PST.
2. The winners’ facebook / twitter ID will be listed on www.clingmarks.com no later than  1/1/2011.

Eligibility

Giveaway opens only to individuals who are legal residents of the fifty (50) United States (including the District of Columbia) and are 18 years of age or older. Subject to all federal, state and local laws and regulations. Void in Puerto Rico and where prohibited by law. No purchase required to be eligible.

Winner Selection

1. Winner(s) will be selected via random drawing. The odds of being selected depend on the number of eligible entries received.
2. The winners facebook / twitter IDs will be posted on www.clingmarks.com no later than  1/1/2011.
3. It’s the winners responsibility to contact us through email (support AT clingmarks) within a week after the winners list is posted. If we don’t receive a response from a winner within a week, we may re-select another winner randomly from all valid entries for his/her place. We are not responsible for technical email issues that could impair communication.

Agreement to Official Rules

Participation in a Giveaway constitutes entrant’s full and unconditional agreement to and acceptance of these Official Rules and the decisions of the Sponsor, which are final and binding. Winning a prize is contingent upon fulfilling all requirements set forth herein.

Requirements of the Potential Winners

Except where prohibited, the potential winner(s) may be required to complete and return an affidavit of eligibility and liability/publicity release (the “Affidavit/Release”) within seven (7) days of being notified. If a potential winner fails to sign and return the Affidavit/Release within the required time period, an alternate entrant may be selected in his/her place.

Release and Limitations of Liability

By participating in the Giveaway, entrants agree to release and hold harmless the Giveaway Entities from and against any claim or cause of action arising out of participation in the Giveaway or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Giveaway; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) printing errors; (d) lost, late, postage-due, misdirected, or undeliverable mail; (e) errors in the administration of the Giveaway or the processing of entries; or (f) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Giveaway or receipt of any prize. Entrant further agrees that in any cause of action, the Giveaway Entities’ liability will be limited to the cost of entering and participating in the Giveaway, and in no event shall the Giveaway Entities be liable for attorney’s fees. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.
